Governing Law: Shenandoah County, Virginia, USA

These Terms form a binding agreement between the client (“Client,” “you”) and Monica Grimes Portrait Design, LLC (“Company,” “we,” “us”). By booking a session, paying an invoice, or signing a contract, you agree to these Terms.

1. Session Eligibility

Clients must be 18 years or older for boudoir photography. Valid government-issued identification may be required.

2. Minimum Purchase & Prepayment Requirements

A non-refundable session fee is required to secure all bookings.

A minimum purchase of $750 + tax is required for all sessions.

Pre-session payment plans must be established within 10 days of booking.

Minimum purchase and payment plans must be paid in full no less than 30 days before the session date.

If payments are not completed on time, the session will be canceled and payments forfeited.

3. Payment Plans & Default

Products and images are not delivered until all balances are paid in full.

Extensions may be granted with late fees at the photographer’s discretion.

If the Client becomes unresponsive after 3 communication attempts spaced 14 days apart, the Company reserves the right to:

Cancel the session and/or product order

Forfeit payments

Delete unpurchased images

Close the Client’s account

4. Cancellations & Rescheduling

1 complimentary reschedule if session is 90+ days away

Second reschedule 90+ days away: $150 fee

Reschedule 90–30 days: $300 fee

Reschedule under 30 days: $600 fee

If booked under a promotional offer, rescheduling voids promotional terms, and promotional credits/gifts are forfeited.

5. Late Arrival — Studio, Hair & Makeup

Clients are expected to arrive on time. Session time begins at the originally scheduled start time.

Arrivals 15+ minutes late result in shortened session time; session end time is not extended.

Arrivals 30+ minutes late may be treated as a reschedule; rescheduling fees apply and promotional offers are forfeited.

Hair & Makeup: If HMUA services are included and the Client is late, services may be shortened or modified to maintain schedule without fee adjustment.

Late arrival does not change or reduce the minimum purchase requirement.

6. Refund Policy

No refunds are given for:

Session fees

Minimum purchases

Pre-session payment plans

Digital products

Failure to appear or communicate

Rescheduled or canceled appointments outside policy terms

Product Guarantee: Physical products will be replaced if defective or damaged. Defects must be reported within 7 days of delivery.

7. Communication Requirements

If responses are required from the Client, the Client agrees to respond within a reasonable timeframe.
If the Company attempts contact 3 times over 14 days each without response, the session may be canceled and payments forfeited.

8. Image Rights & Usage

Monica Grimes Portrait Design, LLC retains copyright to all images.

Purchased digital images include personal printing rights only.

Commercial use, editing, filters, or modifications of images are prohibited.

Images are not used publicly without a signed model release.

9. Conduct & Safety

To maintain a safe and professional environment:

Clients must not be under the influence of alcohol or drugs.

Harassment, inappropriate conduct, or disrespect may result in immediate termination of services without refund.

10. Delivery & Turnaround

Products are delivered within 6–8 weeks after session completion or final payment, whichever is later.

No products or digital files are released until all balances are paid in full.

11. Studio Discretion

We reserve the right to decline or discontinue services due to:

Non-payment

Failure to communicate

Disrespectful behavior

Safety concerns

Violation of these Terms

12. Legal

All legal matters must be resolved in the courts of Shenandoah County, Virginia, USA.

13. Acknowledgment

By booking or paying for services, you acknowledge that you have read, understood, and agree to these Terms.
